Preparation of planning applications for most types of development including industrial, commercial, housing, equestrian, leisure, minerals and waste etc. The new planning regime requires additional vigilance to ensure that landowners interests are safeguarded as well as ensuring they do not miss out on potential development opportunities.

New Planning System

The new simplified planning system, introduced as a result of the Planning and Compensation Act 2004, is not as simple as it is claimed to be. Out have gone the familiar Structure Plans and Local Plans. In their place we now have Local Development Frameworks (LDFs), a range of documents known as Development Plan Documents (DPDs), which, together with the Regional Spatial Strategies (RSS’s), form the Development Plan for local authorities. DPDs must conform with the RSSs and be subject to examination in public by an Inspector whose report will be binding on the council.

Documents to be produced include:

  • Statement of Community Involvement
  • Core Strategies
  • Area Action Plans (AAPs)
  • Adopted Proposals Maps (APMs)
  • Generic Development Control Policies

It remains to be seen whether this new system will speed up the planning process. It is intended to operate on a rolling review so it is more important than ever for developers and landowners to engage proactively in the process if opportunities are not to be lost.

Planning Appeals

Although the great majority of planning permissions are obtained at the first application, there are however, times when more persistence is needed. As a consequence, we have acheived a number of successes with planning appeals for a wide range of projects including housing and minerals applications.
