Halletec were called upon to provide expert witness support in a case which involved the application of the planning regulations arising from the Review of Old Mining Permissions (ROMP) regulations. The Mineral Planning Authority (MPA) declared a part of the ROMP planning permission, which was an active quarry not to have been properly registered and declared it lost. As a consequence the quarry owner sought redress from its planning consultant. Expert advice was provided in respect of the application of the ROMPS legislation and the valuation of the mineral assets declared lost as a result of the action by the MPA. The case was resolved when the MPA had a change of heart and declared the ROMP permission to be valid in its entirety.
Case Study: Arbitration
Project: Clay and landfill site in North Wales
Client: RICS Dispute Resolution Service
Halletec were appointed through the RICS arbitration appointments system to act in a dispute that had arisen between a mineral operator and its neighbouring former owner who retained a supply agreement. The case centered on the interpretation of the terms of the contract to work and supply clay from the adjoining quarry and whether it was economically viable to continue working.
